Conditions and rules for the purchase of goods

General provisions

1.1 These Terms and Conditions of Sale and Purchase of Goods (hereinafter referred to as the "Terms and Conditions") are a binding legal document between the parties, which sets out the rights and obligations of the Buyer and the Seller, the conditions for the purchase of the Goods and the conditions of payment for them, the procedure for the delivery of the Goods and the procedure for the return of the Goods, the parties' liability and any other provisions relating to the sale and purchase of the Goods.
1.2 By placing an order, the Buyer confirms that he/she accepts these Terms and Conditions.
1.3 The contract between the Buyer and the Seller shall be deemed to have been concluded as from the moment when the Buyer has paid the required amount for the goods purchased.

Protection of personal data

2.1 By placing an order, the Buyer agrees to the processing of the personal data provided by him/her for the purpose of the order. The Buyer also agrees that the e-mail address provided by the Buyer shall be sent information notifications necessary for the execution of the order.
2.2 The Seller undertakes not to disclose the Buyer's personal data to third parties, except when required by a competent public authority in cases provided for by the laws of the Republic of Lithuania or with the Buyer's separate written consent.

Rights and obligations of the buyer.

3.1 The Buyer undertakes to pay the Seller the agreed amount for the goods ordered and to accept them.
3.2 Provide full, complete and correct information to the Seller. If the Buyer provides inaccurate, false or misleading information, the Seller shall have the right to cancel the Buyer's order.
3.2 In the event of a change in the Buyer's information provided to the Seller, the Buyer shall immediately notify the Seller of such change.
3..3 The Buyer shall have the right to withdraw from the contract of sale of goods in accordance with the provisions set out in Clause 8 hereof.
3.4 By placing an order, the Buyer agrees to these Terms and Conditions of Sale and Purchase and undertakes to abide by these Terms and Conditions of Sale and Purchase and by the applicable legislation of the Republic of Latvia.

Seller's rights and obligations.

4.1 The Seller undertakes to provide all the conditions for the Buyer to make proper use of the services provided.
4.2 The Seller undertakes to respect the Buyer's right to privacy with respect to the Buyer's personal information, and not to disclose such information to any third party.
4.3 The Seller may, in the event of important circumstances, temporarily or permanently suspend the operation of the website without prior notice to the Buyer.
4.4 The Seller may unilaterally modify the terms and conditions of the present Regulations.

Ordering, prices, payment procedures, deadlines.

5.1 The Buyer may place orders 7 days a week, 24 hours a day.
5.2 Orders shall be accepted using the order forms available at www.italianbags.lt. All prices in the online shop are quoted in euros, including VAT.
5.4. The Buyer may pay for the goods by:
5.4.1. electronic banking
5.4.2. VISA/MASTERCARD
5.4.3. payment can be made by using Swedbank, Seb, Luminor, Citadele and Šiaulių bankas electronic banking services. Payments can be made in Euro currency. Payments are processed using the MakeCommerce.lt payment platform.
5.5.

Delivery.

6.1 The Buyer undertakes to specify the exact place of delivery of the Goods.
6.2 The Buyer undertakes to take delivery of the Goods himself. In the event that the Buyer is unable to accept the goods himself and the goods have been delivered to the address indicated, the Buyer shall not be entitled to claim against the Seller for delivery of the goods to the wrong entity.
6.3. The goods shall be delivered to the Buyer by OMNIVA's couriers to the Buyer's home and post office. The Buyer may collect the goods himself at P. Žadeikos g. 9, Vilnius - Italian Bags Showroom, by prior appointment by phone +370 (666) 86 671.
6.4. The goods shall be delivered to the Buyer within 1-3 working days after the payment is made.
6.5.
In all cases, the Seller shall be exempt from liability for failure to meet delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer's fault or due to circumstances beyond the Seller's control.
6.7..7 The Buyer must inform the Seller immediately if the consignment is received in damaged packaging, if the consignment contains unsolicited goods or the wrong quantity of goods, or if the consignment is incomplete.
6.8. The Buyer must provide the Seller with photographs of the damaged parcel and/or item(s) by email.
6.9. If the Goods are returned to the Seller due to an incorrect or inaccurate address, or if the Goods are returned to the Seller without being collected from the post office within the maximum retention period, the Buyer must pay the Seller the cost of re-shipment and, if the Goods have been returned by a post office or by a courier, the Seller must pay the Seller's costs of returning them. If the Buyer refuses to accept the re-shipment (i.e. if the Buyer requests a refund), the money for the re-shipment shall not be refunded to the Buyer.

Product quality, guarantees.

7.1 All details of the goods sold on www.italianbags.lt shall be set out in the description of the goods accompanying each item.

7.2 The quantities of goods displayed in the shop in the photographs do not always relate to the price of the goods - goods may be displayed at more than one price per item. The colour of the goods may vary slightly depending on the monitor used by the Buyer.
7.3 The Seller may provide an appropriate quality guarantee for individual types of goods, the specific term and other conditions of which are set out in the description of the goods.

Returning and exchanging goods

Marketing and information.

9.1 The Seller www.italianbags.lt may organise various promotions and offers.
9.2 The Seller has the right to unilaterally, without prior notice, change the terms of promotions, as well as to cancel them. Any change or cancellation of the terms and conditions of promotions shall be effective from the moment of the change or cancellation.
9.3 The Buyer shall send all notifications and questions to the contacts indicated in the "Contact" section of the Seller's e-shop.

Final provisions.

10.1 These Terms and Conditions of Sale and Purchase of Goods are made in accordance with the laws and regulations of the Republic of Lithuania.
10.2 These Terms and Conditions of Sale and Purchase of Goods shall be governed by the law of the Republic of Lithuania. All disagreements arising from the performance of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the laws of the Republic of Lithuania.
